Deze Algemene Voorwaarden zijn van toepassing op elk aanbod van Thuisely en op elke overeenkomst op afstand tussen Thuisely en een consument. Deze Nederlandse versie is bindend; bij tegenstrijdigheid met de Engelse vertaling hieronder, prevaleert deze Nederlandse versie.

1. Over Thuisely

Thuisely is een eenmanszaak, geregistreerd in Nederland, die 3D-geprinte woonaccessoires verkoopt via thuisely.com.

Thuisely is binnen 2 werkdagen per e-mail bereikbaar voor alle vragen over bestellingen, retouren en klachten.

2. Definities

“Thuisely”, “wij”, “ons”: de verkoper zoals omschreven in artikel 1.
“Consument”, “u”: de natuurlijke persoon die een bestelling plaatst en niet handelt in de uitoefening van een beroep of bedrijf.
“Overeenkomst” / “overeenkomst op afstand”: de overeenkomst tussen Thuisely en de consument voor de verkoop van producten via de website.
“Bedenktijd”: de termijn waarbinnen de consument gebruik kan maken van zijn herroepingsrecht.
“Producten”: 3D-geprinte woonaccessoires die door Thuisely worden aangeboden, waaronder onder meer plantenclips en plantenpothogers.

3. Toepasselijkheid

Deze Algemene Voorwaarden zijn van toepassing op elk aanbod van Thuisely en op elke overeenkomst op afstand tussen Thuisely en een consument.
Voordat de overeenkomst op afstand wordt gesloten, wordt de tekst van deze Algemene Voorwaarden aan de consument beschikbaar gesteld. Indien dit redelijkerwijs niet mogelijk is, laat Thuisely voorafgaand aan het sluiten van de overeenkomst weten dat de voorwaarden bij Thuisely kunnen worden ingezien of op verzoek kosteloos worden toegezonden.
Indien de overeenkomst op afstand elektronisch wordt gesloten, wordt de tekst langs elektronische weg beschikbaar gesteld, zodanig dat deze door de consument eenvoudig kan worden opgeslagen op een duurzame gegevensdrager.
Indien naast deze Algemene Voorwaarden aanvullende voorwaarden van toepassing zijn, kan de consument zich bij tegenstrijdigheid steeds beroepen op de voor hem meest gunstige bepaling.

4. Aanbod en prijzen

Indien een aanbod een beperkte geldigheidsduur heeft of onder voorwaarden geschiedt, wordt dit uitdrukkelijk vermeld.
Het aanbod bevat een volledige en nauwkeurige omschrijving van de aangeboden producten, met kwalitatief goede afbeeldingen. Kleuren op het scherm kunnen licht afwijken van het daadwerkelijke product door beeldscherminstellingen.
Alle prijzen op thuisely.com zijn in euro’s (€) en inclusief 21% btw, tenzij anders vermeld.
Prijzen zijn exclusief verzendkosten, die apart tijdens het bestelproces worden getoond.
Thuisely behoudt zich het recht voor de prijzen voor toekomstige bestellingen aan te passen.
Kennelijke fouten of vergissingen in het aanbod binden Thuisely niet.

5. De overeenkomst

Met inachtneming van artikel 4 komt de overeenkomst tot stand op het moment van aanvaarding van het aanbod door de consument.
Bij elektronische aanvaarding bevestigt Thuisely onverwijld de ontvangst via een orderbevestiging per e-mail.
Thuisely treft passende technische en organisatorische maatregelen ter beveiliging van de elektronische gegevensoverdracht, waaronder beveiligde (versleutelde) betaling via Mollie.

6. Herroepingsrecht

6.1 Standaardproducten. Voor standaard catalogusproducten heeft de consument het recht om de overeenkomst binnen 14 dagen zonder opgave van redenen te herroepen.
De bedenktijd verstrijkt 14 dagen na de dag waarop de consument (of een aangewezen derde) het product fysiek in ontvangst heeft genomen.
Het product mag alleen worden uitgepakt of gebruikt voor zover nodig om de aard, kenmerken en werking vast te stellen.
Om te herroepen, informeert de consument Thuisely via een ondubbelzinnige verklaring (bijv. e-mail) vóór het verstrijken van de bedenktijd.
De consument stuurt het product terug binnen 14 dagen na de herroepingsmelding.
De directe retourkosten zijn voor rekening van de consument, tenzij Thuisely anders heeft aangegeven.
Bij gebruik verder dan noodzakelijk kan de consument aansprakelijk zijn voor waardevermindering.
Thuisely vergoedt alle betalingen, inclusief standaard bezorgkosten, binnen 14 dagen na de herroepingsmelding.

6.2 Gepersonaliseerde producten. Voor producten die op specificatie van de consument zijn vervaardigd of duidelijk gepersonaliseerd zijn, geldt het herroepingsrecht van 6.1 niet, conform artikel 6:230p sub c BW. Dit wordt vermeld op de productpagina. De huidige standaard catalogusproducten van Thuisely worden niet als gepersonaliseerd beschouwd enkel omdat zij op bestelling 3D geprint worden.

7. Prijs en betaling

Prijzen worden niet verhoogd tijdens de vermelde geldigheidsduur, behalve bij btw-wijzigingen.
Betaling is mogelijk via iDEAL en creditcard/betaalkaart (Visa, Mastercard), beveiligd via Mollie.
Tenzij anders overeengekomen, dient het verschuldigde bedrag volledig te zijn voldaan vóór verwerking en verzending.
De consument meldt onjuistheden in betaalgegevens onverwijld aan Thuisely.

8. Levering en uitvoering

Thuisely neemt de grootst mogelijke zorgvuldigheid in acht bij bestellingen.
Als leveringsadres geldt het adres dat de consument heeft opgegeven.
Thuisely verzendt op dit moment uitsluitend binnen Nederland.
Bestellingen worden met bekwame spoed uitgevoerd, uiterlijk binnen 30 dagen. Bij vertraging of het niet (volledig) kunnen leveren, wordt de consument hierover binnen 30 dagen geïnformeerd.
Bij ontbinding betaalt Thuisely het betaalde bedrag onverwijld terug.
Het risico van beschadiging of verlies berust bij Thuisely tot het moment van bezorging, tenzij anders overeengekomen.

9. Verzendkosten

Verzendkosten worden berekend en getoond tijdens het bestelproces, en kunnen variëren op basis van grootte en verpakking (bijv. brievenbuspakket versus standaardpakket). Actuele tarieven en een eventuele gratis-verzendgrens staan vermeld op de verzendpagina en tijdens het bestelproces.

10. Conformiteit en garantie

Thuisely garandeert dat producten voldoen aan de overeenkomst, de vermelde specificaties, redelijke eisen van deugdelijkheid/bruikbaarheid en de op de sluitingsdatum geldende wettelijke bepalingen.
Gebreken of verkeerd geleverde producten dienen binnen redelijke tijd schriftelijk te worden gemeld.
Wettelijke garantierechten (conformiteit) blijven onverminderd naast eventuele commerciële garantie gelden.

11. Aansprakelijkheid

De aansprakelijkheid van Thuisely is beperkt tot het bedrag dat de consument voor de betreffende bestelling heeft betaald, tenzij sprake is van opzet of grove schuld.
Thuisely is niet aansprakelijk voor schade door onjuiste of onvolledige bezorggegevens van de consument.
Niets in deze voorwaarden beperkt aansprakelijkheid die naar Nederlands recht niet beperkt mag worden, waaronder bij overlijden of letsel door een gebrekkig product.

12. Klachtenregeling

Klachten dienen volledig en duidelijk omschreven binnen redelijke tijd te worden ingediend via info@thuisely.com.
Klachten worden binnen 14 dagen beantwoord; indien meer tijd nodig is, ontvangt de consument binnen die termijn een ontvangstbevestiging met indicatie van de verwachte reactietermijn.
EU-consumenten kunnen ook het ODR-platform van de Europese Commissie gebruiken via ec.europa.eu/consumers/odr.

13. Persoonsgegevens

Thuisely verwerkt persoonsgegevens uitsluitend voor het verwerken en bezorgen van bestellingen, het afhandelen van betalingen via Mollie en het beantwoorden van klantvragen, conform de AVG. Zie de afzonderlijke Privacyverklaring op de website voor meer informatie.

14. Intellectueel eigendom

Alle productontwerpen, foto’s, teksten en overige inhoud op thuisely.com zijn eigendom van Thuisely of haar licentiegevers. Verveelvoudiging of gebruik zonder voorafgaande schriftelijke toestemming is niet toegestaan.

15. Overmacht

Thuisely is niet gehouden verplichtingen na te komen indien zij daartoe verhinderd is door omstandigheden die haar niet zijn toe te rekenen.

16. Toepasselijk recht en geschillen

Op overeenkomsten waarop deze voorwaarden van toepassing zijn, is uitsluitend Nederlands recht van toepassing, ook als de consument in het buitenland woont.
Dwingende consumentenbeschermingsbepalingen van het woonland van de consument blijven van toepassing voor zover EU-recht dit vereist.
Geschillen kunnen worden voorgelegd aan de bevoegde Nederlandse rechter, onverminderd het recht van de consument om te procederen bij de rechter van zijn woonplaats voor zover dwingend recht dit toestaat.

17. Wijzigingen

Thuisely kan deze Algemene Voorwaarden van tijd tot tijd wijzigen. Op een bestelling is de versie van toepassing die gepubliceerd is op thuisely.com op het moment van bestellen. Materiële wijzigingen worden op de website gecommuniceerd.

These Terms & Conditions (“Algemene Voorwaarden”) apply to every offer made by Thuisely and to every distance contract concluded between Thuisely and a consumer.

1. About Thuisely

2. Definitions

“Thuisely”, “we”, “us”: the seller as described in Article 1.
“Consumer”, “you”: the natural person placing an order who is not acting in the course of a trade, business, craft or profession.
“Agreement” / “distance contract”: the agreement concluded between Thuisely and the consumer for the sale of products via the website.
“Withdrawal period”: the period within which the consumer may use the right of withdrawal.
“Products”: 3D-printed home décor items offered for sale by Thuisely, including but not limited to vine clips and plant risers.

3. Applicability

These Terms & Conditions apply to every offer by Thuisely and to every distance contract between Thuisely and a consumer.
Before a distance contract is concluded, the text of these Terms & Conditions is made available to the consumer.
If the distance contract is concluded electronically, the text will be made available electronically so it can be stored on a durable medium.
If specific product or service conditions apply in addition, the consumer may always invoke the provision most favourable to them in case of conflict.

4. Offers and prices

If an offer has a limited period of validity or is subject to conditions, this is explicitly stated.
The offer contains a complete and accurate description of the products, including high-quality images. Colours shown on screen may differ slightly due to monitor settings.
All prices shown on thuisely.com are in euros (€) and include 21% Dutch VAT (BTW), unless stated otherwise.
Prices do not include shipping costs, shown separately at checkout.
Thuisely reserves the right to adjust prices for future orders.
Obvious errors or mistakes in the offer do not bind Thuisely.

5. The agreement

Subject to Article 4, the agreement is concluded when the consumer accepts the offer.
Thuisely will confirm receipt of electronic acceptance via an order confirmation email.
Thuisely secures the electronic transfer of data, including encrypted payment via Mollie.

6. Right of withdrawal (herroepingsrecht)

6.1 Standard products. For standard catalogue products, the consumer has the right to withdraw within 14 days without giving any reason.
The withdrawal period expires 14 days after the consumer (or a designated third party) takes physical possession of the product.
The product should only be unpacked or used to the extent necessary to establish its nature and characteristics.
To withdraw, the consumer must inform Thuisely via an unambiguous statement (e.g. email) before the period expires.
The consumer must return the product within 14 days of that notice.
Direct return costs are borne by the consumer unless Thuisely stated otherwise.
Excess use beyond what’s necessary may result in liability for diminished value.
Thuisely will refund all payments, including standard delivery costs, within 14 days of being informed of the withdrawal.

6.2 Personalised products. Where products are made to the consumer’s specifications or clearly personalised, the right of withdrawal does not apply, per Article 6:230p(c) Dutch Civil Code. This will be stated on the relevant product page. Thuisely’s current standard catalogue items are not considered personalised solely for being 3D printed on demand.

7. Price and payment

Prices will not be increased during the stated validity period, except for VAT rate changes.
Payments can be made via iDEAL and credit/debit card (Visa, Mastercard), processed securely through Mollie.
Unless otherwise agreed, amounts owed must be paid in full before the order is processed and dispatched.
The consumer must report payment inaccuracies to Thuisely without delay.

8. Delivery and execution

Thuisely takes the greatest care in receiving and executing orders.
The place of delivery is the address the consumer provided.
Thuisely currently ships within the Netherlands only.
Orders are executed within 30 days unless otherwise agreed; delays are communicated within 30 days of ordering.
Thuisely will refund amounts paid without undue delay if the agreement is dissolved.
Risk of damage or loss rests with Thuisely until delivery, unless otherwise agreed.

9. Shipping costs

Shipping costs are calculated and shown at checkout, and may vary based on the size and packaging requirements of the order. Current rates and any free-shipping threshold are shown on the shipping information page and at checkout.

10. Conformity and warranty

Thuisely guarantees products comply with the agreement, the stated specifications, and applicable legal provisions.
Defects or incorrectly delivered products must be reported in writing within a reasonable time.
Statutory warranty rights under Dutch consumer law remain unaffected by any commercial guarantee.

11. Liability

Thuisely’s liability is limited to the amount paid for the relevant order, unless damage results from intent or gross negligence.
Thuisely is not liable for damage caused by incorrect or incomplete delivery information provided by the consumer.
Nothing in these Terms limits liability that cannot be limited under Dutch law, including for death or personal injury caused by a defective product.

12. Complaints procedure

Complaints must be submitted fully and clearly described via info@thuisely.com within a reasonable time.
Complaints will be answered within 14 days; if more time is needed, an acknowledgement with an expected response time will be sent within that period.
EU consumers may also use the European Commission’s ODR platform at ec.europa.eu/consumers/odr.

13. Personal data

Thuisely processes personal data solely to process and deliver orders, handle payments via Mollie, and respond to customer queries, in accordance with the GDPR. See Thuisely’s separate Privacy Policy for details.

14. Intellectual property

All product designs, photography, text, and other content on thuisely.com are the property of Thuisely or its licensors. Reproduction or use without prior written permission is not permitted.

15. Force majeure

Thuisely is not obliged to fulfil obligations if prevented by circumstances not attributable to its fault.

16. Applicable law and disputes

Agreements are governed exclusively by Dutch law, even if the consumer is domiciled abroad.
Mandatory consumer protection provisions of the consumer’s country remain unaffected where EU law requires.
Disputes may be submitted to the competent Dutch court, without prejudice to the consumer’s right to bring proceedings in their own place of residence where mandatory law permits.

17. Amendments

Thuisely may amend these Terms & Conditions from time to time. The version applicable to an order is the version published on thuisely.com at the time of ordering. Material changes will be communicated on the website.
