Terms & Conditions — Thuisely

These Terms & Conditions (“Algemene Voorwaarden”) apply to every offer made by Thuisely and to every distance contract concluded between Thuisely and a consumer. This document is provided in English for clarity; in case of any conflict, the Dutch-language version filed with the Chamber of Commerce (KVK) prevails, unless Thuisely only publishes an English version, in which case this version is binding.

1. About Thuisely

Thuisely is a sole proprietorship (eenmanszaak) registered in the Netherlands, offering 3D-printed home décor products for sale via thuisely.com.

2. Definitions

  • “Thuisely”, “we”, “us”: the seller as described in Article 1.
  • “Consumer”, “you”: the natural person placing an order who is not acting in the course of a trade, business, craft or profession.
  • “Agreement” / “distance contract”: the agreement concluded between Thuisely and the consumer for the sale of products via the website.
  • “Withdrawal period”: the period within which the consumer may use the right of withdrawal.
  • “Products”: 3D-printed home décor items offered for sale by Thuisely, including but not limited to vine clips and plant risers.

3. Applicability

  • These Terms & Conditions apply to every offer by Thuisely and to every distance contract between Thuisely and a consumer.
  • Before a distance contract is concluded, the text of these Terms & Conditions is made available to the consumer. Where this is not reasonably possible, Thuisely will indicate, before the contract is concluded, that the Terms & Conditions can be viewed at Thuisely’s premises or will be sent free of charge as soon as possible at the consumer’s request.
  • If the distance contract is concluded electronically, the text of these Terms & Conditions will be made available to the consumer electronically in such a way that it can be easily stored by the consumer on a durable medium.
  • If specific product or service conditions apply in addition to these general Terms & Conditions, the second and third paragraph apply correspondingly, and in the event of conflicting terms, the consumer may always invoke the applicable provision that is most favourable to them.

4. Offers and prices

  • If an offer has a limited period of validity or is subject to conditions, this is explicitly stated in the offer.
  • The offer contains a complete and accurate description of the products offered, including high-quality images, sufficient to allow a proper assessment of the offer by the consumer. Colours shown on screen may differ slightly from the actual product due to monitor settings.
  • All prices shown on thuisely.com are in euros (€) and include 21% Dutch VAT (BTW), unless stated otherwise.
  • Prices do not include shipping costs, which are shown separately during checkout before the order is finalised.
  • Thuisely reserves the right to adjust prices for future orders. Prices applicable at the time the order is placed apply to that order.
  • Obvious errors or mistakes in the offer, such as evident pricing errors, do not bind Thuisely.

5. The agreement

  • Subject to the provisions in paragraph 4, the agreement is concluded at the moment the consumer accepts the offer and meets the corresponding conditions.
  • If the consumer has accepted the offer electronically, Thuisely will confirm receipt of the acceptance of the offer electronically without delay, by sending an order confirmation to the email address provided.
  • Thuisely will take appropriate technical and organisational measures to secure the electronic transfer of data and will ensure a secure web environment, including secure (encrypted) payment via Mollie.

6. Right of withdrawal (herroepingsrecht)

6.1 Standard products

For standard catalogue products (such as standard vine clips and plant risers as offered on thuisely.com), the consumer has the right to withdraw from the agreement within 14 days without giving any reason, in accordance with Dutch and EU consumer law.

  • The withdrawal period expires 14 days after the day on which the consumer, or a third party indicated by the consumer (not being the carrier), takes physical possession of the product.
  • During this period, the consumer is asked to handle the product and its packaging with care. The product should be unpacked or used only to the extent necessary to establish the nature, characteristics, and proper functioning of the product.
  • To exercise the right of withdrawal, the consumer must inform Thuisely of this decision by means of an unambiguous statement (e.g. by email), before the withdrawal period has expired.
  • The consumer must return the product without undue delay, and in any event no later than 14 days after the day on which the consumer informed Thuisely of the withdrawal.
  • The direct cost of returning the product is borne by the consumer, unless Thuisely has indicated that it will bear these costs, or has failed to inform the consumer about the obligation to bear these costs.
  • If the consumer withdraws after having already used the product beyond what is necessary to establish its nature and characteristics, the consumer may be liable for the resulting diminished value of the product.
  • Thuisely will refund all payments made by the consumer, including standard delivery costs charged, without undue delay and in any case within 14 days of being informed of the withdrawal. Thuisely may withhold reimbursement until it has received the product back, or until the consumer has demonstrated that the product has been returned, whichever is earlier.

6.2 Personalised products (future / where applicable)

If Thuisely offers products made to the consumer’s own specifications or that are clearly personalised (for example, a custom colour, custom text, or custom dimensions specifically requested by the consumer), the right of withdrawal described in Article 6.1 does not apply to those specific items, in accordance with Article 6:230p sub (c) of the Dutch Civil Code. Where applicable, this will be clearly stated on the relevant product page before the consumer completes the order. At the time of publishing these Terms, Thuisely’s standard catalogue items are not considered personalised goods solely because they are produced on demand using a 3D printer.

7. Price and payment

  • During the validity period stated in the offer, the prices of the offered products will not be increased, except for price changes resulting from changes in VAT rates.

Payments can be made via the following methods, processed securely through Mollie: iDEAL, and credit/debit card (Visa, Mastercard).

  • Unless otherwise agreed, amounts owed by the consumer must be paid in full before the order is processed and dispatched.
  • The consumer has the duty to report inaccuracies in payment details provided or stated to Thuisely without delay.

8. Delivery and execution

  • Thuisely will take the greatest possible care when receiving and executing orders for products.
  • The place of delivery is the address that the consumer has made known to Thuisely.
  • Thuisely currently ships within the Netherlands only.
  • Thuisely will execute accepted orders with due speed, but at the latest within 30 days, unless a different delivery period has been agreed. If delivery is delayed, or if an order cannot be filled or only partially filled, the consumer will be informed of this within 30 days of placing the order.
  • In the event of dissolution of the agreement under the previous paragraph, Thuisely will refund the amount paid by the consumer without undue delay.
  • The risk of damage and/or loss of products rests with Thuisely until the moment of delivery to the consumer, unless explicitly agreed otherwise.

9. Shipping costs

Shipping costs are calculated and displayed at checkout based on the products in the order, and may vary depending on the size and packaging requirements of the items ordered (for example, letterbox-suitable items versus standard parcel items). Current shipping rates and any free-shipping threshold are shown on the website’s shipping information page and during checkout, and form part of the offer accepted by the consumer.

10. Conformity and warranty

  • Thuisely guarantees that the products comply with the agreement, the specifications stated in the offer, reasonable requirements of soundness and/or usability, and the legal provisions and/or government regulations existing on the date of the conclusion of the agreement.
  • Any defect or incorrectly delivered product must be reported to Thuisely in writing within a reasonable time after discovery.
  • Statutory warranty rights under Dutch consumer law (conformiteit) remain unaffected by any commercial guarantee Thuisely may offer.

11. Liability

  • Thuisely’s liability for damage arising from an attributable failure to perform the agreement is limited to the amount paid by the consumer for the relevant order, unless the damage results from intent or gross negligence on the part of Thuisely.
  • Thuisely is not liable for damage of any kind caused by the consumer providing incorrect or incomplete delivery information.
  • Nothing in these Terms & Conditions limits or excludes liability that cannot be limited or excluded under Dutch law, including liability for death or personal injury caused by a defective product.

12. Complaints procedure

  • Complaints about the execution of the agreement must be submitted to Thuisely fully and clearly described, within a reasonable time after the consumer has discovered the defects.

Complaints can be submitted via email to info@thuisely.com.

  • Complaints submitted to Thuisely will be answered within a period of 14 days from the date of receipt. If a complaint requires a longer processing time, Thuisely will respond within the 14-day period with an acknowledgement of receipt and an indication of when the consumer can expect a more detailed answer.

Consumers in the EU may also use the European Commission’s Online Dispute Resolution platform at ec.europa.eu/consumers/odr to submit complaints, particularly for cross-border purchases.

13. Personal data

Thuisely processes personal data (such as name, address, email, and order details) solely for the purpose of processing and delivering orders, handling payments via Mollie, and responding to customer queries, in accordance with the General Data Protection Regulation (GDPR/AVG). For further details, see Thuisely’s separate Privacy Policy, available on the website.

14. Intellectual property

All product designs, photography, text, and other content on thuisely.com are the property of Thuisely or its licensors and are protected under applicable intellectual property law. Reproduction or use of this content without prior written permission from Thuisely is not permitted.

15. Force majeure

Thuisely is not obliged to fulfil any obligation towards the consumer if it is prevented from doing so as a result of a circumstance which is not attributable to fault, and which is not the responsibility of Thuisely by virtue of law, a legal act, or generally accepted standards.

16. Applicable law and disputes

  • Agreements between Thuisely and the consumer to which these Terms & Conditions apply are exclusively governed by Dutch law, even if the consumer is domiciled abroad.
  • Mandatory consumer protection provisions of the country in which the consumer is domiciled remain unaffected where applicable EU law so requires.
  • Disputes between the consumer and Thuisely that cannot be resolved by mutual agreement may be submitted to the competent Dutch court, without prejudice to the consumer’s right to bring proceedings before the court of their own place of residence where mandatory law so permits.

17. Amendments

Thuisely may amend these Terms & Conditions from time to time. The version applicable to an order is the version published on thuisely.com at the time the order is placed. Material changes will be communicated on the website.
